1. Acceptance of Terms

By downloading, accessing, or using Eat AI, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you must not use the application.

3. AI-Generated Content & User Data

All wellness plans and recipes are generated using AI technology. By using these features, you agree to the following:

• Consent to Process: You grant us permission to process your biometric and preference data via our AI partner, Google Gemini, to generate personalized insights.
• Ownership: You retain ownership of your personal health data. You grant us a license to host and process this data solely to provide the Service.
• AI Accuracy: AI outputs are estimates and may contain errors. We do not guarantee the nutritional accuracy or suitability of any suggestion for your specific health condition.

4. Prohibited Uses

You agree not to:

• Provide misleading or fraudulent health and biometric data.
• Attempt to reverse engineer, scrape, or unauthorizedly access our AI models or databases.
• Use the app for any illegal purposes or in violation of local laws.
• Impersonate a medical professional based on AI-generated insights.

5. Limitation of Liability & Disclaimer

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND.

To the maximum extent permitted by Moroccan law, Eat AI and BioValley shall not be liable for any indirect, incidental, or consequential damages resulting from your use of the service or reliance on AI-generated insights. This includes, but is not limited to, health issues or financial losses.

6. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Morocco. Any disputes shall be subject to the exclusive jurisdiction of the courts of Morocco.

7. Subscriptions and Purchases

Eat AI offers a "Pro" subscription that provides enhanced features. By subscribing, you agree to the following:

• Billing: Subscriptions are billed through your Apple ID or Google Play account.
• Auto-Renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.
• Cancellation: You can manage and cancel your subscription anytime via your App Store or Play Store account settings.
• Refunds: Refund requests are handled by the respective app store (Apple/Google) and are subject to their refund policies.

8. Intellectual Property

The Eat AI application, including its original content (excluding AI-generated meal plans), mascot designs, features, and functionality, are and will remain the exclusive property of BioValley and its licensors.

9. Platform Specific Terms (Apple EULA)

If you are using Eat AI on an iOS device, you acknowledge that:

• These Terms are between you and BioValley only, not Apple.
• BioValley is solely responsible for the app and its content.
• Apple has no obligation to furnish any maintenance and support services for the app.
• In the event of any failure of the app to conform to any applicable warranty, you may notify Apple for a refund of the purchase price; to the maximum extent permitted by law, Apple will have no other warranty obligation whatsoever.
• Apple is not responsible for addressing any claims related to the app or your possession/use of it.
• Apple and its subsidiaries are third-party beneficiaries of these Terms.
